II. 2. Activities, tasks

The tasks of the National Data Asset Management Agency (hereinafter: the Agency) are regulated by Act No. XCI. of 2021 on national data asset and Government Decree No. 607/2021 (XI. 5.) on certain detailed rules relating to the use of national data asset (hereinafter: Decree). 

According to these legislations the Agency: 

  1. promotes and supports the implementations of Act No. LXIII. of 2012 on the reuse of public data: 

a) prepares and updates the list of registers and databases containing reusable public data in accordance with Act No. LXIII. of 2012 on the reuse of public data, and ensures the continuous monitoring of their changes;  

b) publishes the list pursuant to subsection a) on the website operated by the Agency, at the same time ensures information about the rights and obligations of public-service bodies and applicants under Act No. LXIII. of 2012 on the reuse of public data; 

c) upon the request of the public-service body or the applicant, the Agency assists in the implementation of the provision for the reuse of public data under Act No. LXIII. of 2012 on the reuse of public data, including assistance in the preparation of the application, the determination of the fee, the preparation of the agreement and the determination of the means of provision; and 

2) with the means provided by the key service provider body, the Agency performs data analysis after anonymization of personal data from the records managed by the public-service body.

II. 22. Remedies information under the Act No. LXIII. of 2012 on the reuse of public data

The applicant may apply to the court for a review of the amount of the fee for making the public data available for re-use, if the request for making the public data available for re-use or if the request is rejected or if the 20 working days or, in case of an extension, the total of 40 working days for the request have expired without result. The public-service body must prove the lawfulness of the request or the justification of the amount of the fee for making the public data available for re-use. The action shall be brought against the public-service body which rejected the request within 10 days of the date of notification of the rejection, of the expiry of the time limit for the settlement of the request without result or – in the case of an action for review of the amount of the fee –, of the expiry of the time limit for payment of the fee. Payment of the fee shall not be a bar to bringing an action. Failure to comply with the time limit for bringing an action shall be subject to a certificate. The Agency is subject to the jurisdiction of the Municipal Court of Budapest. If the court grants the application for the provision of public data for re-use, it shall order the public-service body to provide the requested public data for re-use. The court may change the amount of the fee for making the public data available for re-use or may order the public-service body to start a new procedure for determining the amount of the fee. If the applicant has already paid the fee initially established by the public-service body at the time the action was brought and the amount of that fee is higher than the amount of the fee established because of the action, the court shall order the public-service body to reimburse the difference for the applicant.

As of 31 December 2022, the Agency has 40 employees, and their personal allowances are determined by the relevant laws. 

2. Remunerations, salaries, regular allowances, and the total amount of the reimbursement of directors, members of the supervisory board and senior executives: 

Aggregate gross salary and remuneration of the managers of the Agency as of 31 December 2022 is 9.300.000 HUF. Other personal allowances are determined by the relevant laws. The monthly gross salary of the managing director: HUF 0 (based on 6. § (4) of the Act No. CXXII on the more efficient operation of publicly owned companies). 

3. Aggregated type and amount of statutory allowances provided to other employees:
